TEN YEAR LIMITED WARRANTY
All Martin Furniture products carry a TEN YEAR limited warranty to be
free of manufacturing defects in workmanship. Component parts not
manufactured by Martin Furniture such as electrical light fixtures, light
bulbs, electrical surge protectors and drawer glides are warranted by their
respective manufacturers. The warranty is valid only when purchase is
from an authorized retailer of Martin Furniture. For inquires about or
concerns with your Martin product, please contact the retailer from whom
the purchase was made. When making a claim under this warranty, the
owner must contact the retailer from whom the purchase was originally
made. Transportation to and from the retailer is the responsibility of the
purchaser. Once repaired or replaced the item will be returned to the dealer
or customer at no cost.
This warranty does not apply to:
• Any product damaged because of freight or after leaving our facilities
• Any product that is altered or modified in anyway
• Any product that is not properly maintained as recommended by Martin
Furniture or damaged by the cause of detergents, abrasives or harsh
cleaning agents
• Damage due to negligence, accident or abuse
• Items purchased as floor samples or designated “as is” at the time of
purchase
• Products that are no longer being manufactured
LIMITATIONS OF CLAIMS:
EXCEPT FOR YOUR REMEDIES FOR A WARRANTY CLAIM
DESCRIBED IN THE PARAGRAPH ABOVE, MARTIN FURNITURE
MAKES NO WARRANTY, EXPRESS OR IMPLIED, AND SHALL NOT
BE RESPONSIBLE FOR ANY DAMAGES OR CLAIMS, WHETHER OR
NOT SUCH DAMAGES ARE DIRECT, INCIDENTAL, OR
CONSEQUENTIAL. By way of example only, (i.) incidental damages
include items such as phone charges, time lost from work, transportation
costs and cost of renting a product to temporarily replace the warranted
furniture; and (ii) consequential damages include items such as replacing
other property that is damaged when the warranted furniture fails, are not
covered.
THIRD PARTY WARRANTIES:
Your Martin Furniture may contain components, which come labeled with
manufacturers’ warranties, which are in addition to the warranty coverage
provided by Martin Furniture. Any such warranty coverage is the sole
obligation of the manufacturer of that component and you should contact
the manufacturer of that component directly in the event of a warranty
claim.
HOW STATE LAW APPLIES
This warranty gives you specific legal rights, and you may have other
rights, which vary from state to state. Some states do not allow limitations
on how long an implied warranty lasts, and some states do not allow the
exclusion of limitation of incidental or consequential damages, so the above
limitations or exclusions may not apply to you.
